1. VALIDITY OF CONDITIONS

These terms and conditions (T&C) apply to all orders of goods made through the homepage of denium. Decisive is the published version of the T&C on the date of order.
The terms of use are subject to change.
In addition, apply – as long as there are no regulations covered in the T&C – the relevant provisions of the Swiss Code of Obligations.

2. CONTRACT TERRITORY

In the online shop of denium are ‘currently’ only deliveries of goods within Switzerland and scheduled to the principality of Lichtenstein. For orders from abroad, please contact us.

3. PRICES

The offer is valid while stock lasts. All prices are indicated in Swiss Francs and include VAT of currently 8%. Shipping is free.

4. CONTRACT CLOSING AND WITHDRAWAL

All information about products and prices on the homepage of denium are non-obligatory and non-binding. By ordering via the website the customer makes a binding offer. Denium will confirm the acceptance via email to the customer. Only with this explicit acceptance the contract is closed and the customer is entitled to the delivery of the goods. If the goods ordered by the customer is not available in the required quantity or to the price specified on the website, denium is going to contact the customer as fast as possible with a respective message. In this case, the contract is only valid after the customer confirms the corrected order via email. Orders and arrangements made through telephone are only valid if confirmed by letter or email.

In case of writing, printing, or calculation mistakes on the homepage, denium is entitled to a resignation at no charge.

5. PAYMENTS

The payment of the ordered goods is possible by payment in advance.

6. SHIPPING

Delivery is free and will be sent (registered) through the Swiss Post with PostPac Priority. The delivery of the goods is usually within 2 working days, subject to availability. Responsibility for value and risk are transferred to the carrier at the moment of shipping.

7.RESERVATION OF OWNERSHIP

Until complete settlement of all claims against the customer, the delivered goods remain the property of denium.

8. CANCELLATION RIGHT

The costumer has the right to exchange the goods within 7 days of receipt or to refund with a completed return form. The right of withdrawal may only be legally valid, if the goods are sent back unused, undamaged, complete and in its original packing. After receiving the goods in the condition described, denium will refund the costumer the merchandise value.

9. WARRANTY

Denium guarantees to deliver the goods in perfect quality. However, there should be any defects of the delivered goods, the costumer needs to report the defects in written form within 7 days of receiving the delivery. After returning the deficient goods, the costumer will receive a replacement. If it is not possible to offer a replacement, denium will compensate the payment. Moreover, any claim for reduction, cancellation or compensation for consequential damages is excluded, as far as permitted by law.

10. DATA PRIVACY

All information given by the costumer about his person are being treated strictly confidential and only used by denium itself.

11. DATA SECURITY

An appropriate security technology is being used to protect the costumer’s data against unauthorized processing.
However, no liability for the security of data submitted online can be granted. The data submission is unencrypted.

12. LAW AND JURISDICTION

All contracts made through the homepage of denium are subject to Swiss law.
Orders made by private individuals for private use is directed to the jurisdiction after jurisdiction law. In all other cases, Obwalden is sole jurisdiction.
